Terms of Service

1. Service Description

UpRes.ai ("UpRes", "we", "us") provides an AI-powered image and video upscaling service accessible via a web interface. Our platform uses specialized AI models — including Real-ESRGAN, SeedVR2, RunwayML, and others provided by WaveSpeed.ai — to enhance the resolution and quality of user-uploaded media files. We offer multiple subscription tiers and a pay-as-you-go credit system.

2. Account Terms

You must provide accurate and complete information when creating an account. Each account is for a single individual or legal entity. You are responsible for maintaining the security of your account credentials. You must be at least 13 years of age to use this service.

3. Acceptable Use

You agree not to use UpRes to:

• Upload, process, or distribute illegal content of any kind
• Upload child sexual abuse material (CSAM) or any exploitative content
• Distribute malware, viruses, or other harmful code
• Reverse engineer, decompile, or attempt to extract the AI models or algorithms
• Abuse the service through automated scraping or denial-of-service attacks
• Circumvent usage limits, billing controls, or access restrictions

We reserve the right to immediately suspend or terminate accounts that violate these terms without notice.

4. Subscription & Billing

UpRes offers the following plans:

• Free — 5 images per month, watermarked output
• Pro ($19/month) — 100 images per month, no watermark, commercial license
• Business ($49/month) — 500 images per month, priority processing, API access, commercial license
• Pay-As-You-Go — Purchase credits as needed, no watermark, commercial license

All payments are processed securely through Stripe. Subscriptions renew automatically at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.

5. Intellectual Property

You retain all rights to the images and videos you upload to UpRes. We do not claim ownership of your original files or the processed output. By using the service, you grant UpRes a limited, non-exclusive license to process your files solely for the purpose of delivering the upscaling service. Pro, Business, and Pay-As-You-Go users receive a commercial license for all processed outputs.

6. Data Handling

Uploaded files are stored in encrypted AWS S3 buckets. Original files are automatically deleted 24 hours after job completion. Processed results remain available for download for 7 days, after which they are permanently removed. UpRes does not use your uploads to train AI models. 7. Limitation of Liability

UpRes is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the service's availability, accuracy, or fitness for a particular purpose. We do not guarantee specific uptime, processing speeds, or output quality. In no event shall UpRes's total liability exceed the amount you have paid us in the 12 months preceding the claim.

8. Termination

Either party may terminate this agreement at any time. You may delete your account through the account settings page. We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users or the service infrastructure.

9. Changes to Terms

We may update these terms from time to time. For material changes, we will provide at least 30 days' notice via the email address associated with your account. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
